Bounty Hunting in Delaware

In Delaware, the Department of Safety and Homeland Security is responsible for overseeing the activity of Bounty Hunters and licensing Bail Enforcement Agents. While there are no comprehensive laws applying to Bounty Hunters, in order to arrest a fugitive, Bail Enforcement Agents must be licensed by the state. Furthermore, there is currently a bill being pursued that would required standardization of licensing and practices by Bounty Hunters in Delaware, and, as such, it is important to be aware of the possibility of strict guidelines being implemented in the future.

How to Become a Bounty Hunter in Delaware

Becoming a Bounty Hunter in Delaware is not overly complicated. One can apply to the Department of Safety and Homeland Security for a bail enforcement agent ID card if they are over 21 and have not been convicted of a felony or two misdemeanors involving theft, drugs, or violence. Prior to obtaining a license Bail Enforcement Agents must also “complete training in the following courses: Constitution/Bill of Rights, Laws of Arrest, Laws of Search & Seizure of Persons Wanted, Police Jurisdiction, Use of Deadly Force, and the Rules & Regulations of Bounty Hunters/Bail Enforcement Agents.” While the nature of the training is not specified, become-a-bounty-hunter suggests that training be pursued through a recognized and accredited training institution.

Delaware Bounty Hunter Licenses and Requirements

Aside from the requirements listed above, there are no specific requirements for Bail Enforcement Agents in Delaware. However, to carry a firearm, a 40 hour approved training course must also be completed and no uniforms may be worn that are not first approved by the Detective Licensing Section of the Department of Safety and Homeland Security.
